Nondiscrimination on the Basis of Sexual Orientation Policy

Basis for Policy

In keeping with fair treatment in all employment practices, the Research Foundation Board of Directors adopted a Sexual Orientation Policy Statement (Board Resolution 84-10) on October 23, 1984. This policy was established in order to maintain a work environment that is free of all forms of discrimination on the basis of sexual orientation.

Policy

The Research Foundation of the State University of New York will ensure that no discrimination against a person because of sexual orientation will occur in any of the Foundation's programs or activities or in any of the sponsored programs or activities administered by the Foundation.

All judgments about and actions toward candidates or applicants for employment and employees will be based on their qualifications, abilities, and performance. The attitudes, practices, and preferences of people that are essentially personal in nature, such as private expression of sexual orientation, are unrelated to performance and provide no basis for judgment.

Requirements

Informing Employees/Supervisors of Policy

The Research Foundation operations manager or designee must ensure that all Research Foundation employees and their supervisors are informed of the policy on nondiscrimination on the basis of sexual orientation (See Policy on Nondiscrimination on the Basis of Sexual Orientation in the Forms resource area.) and of the availability of the procedure for resolving allegations of discrimination, which is located in the Equal Employment Opportunity procedure group of the Employees: Personnel Administration business area. The operations manager or designee will inform all new Research Foundation employees of the policy during orientation.

The affirmative action officer or designee must be available to respond to questions regarding the policy on nondiscrimination on the basis of sexual orientation.

Training

At all operating locations, the affirmative action officer or designee must provide supervisors with appropriate training and information to enable them to recognize, avoid, and resolve situations involving discrimination.

Complaint Procedure

When employees feel that the policy on nondiscrimination on the basis of sexual orientation has been violated, operating locations must inform employees that the procedure for resolving allegations of discrimination is available to them.

Responsibilities

Operating Locations

The campus president or designee has the overall responsibility and authority for the location's affirmative action efforts regarding nondiscrimination on the basis of sexual orientation.

The affirmative action officer or designee has the daily responsibility for the location's efforts regarding nondiscrimination on the basis of sexual orientation.

The Research Foundation operations manager or designee is responsible for ensuring that all Foundation employees and their supervisors are informed of the policy on nondiscrimination on the basis of sexual orientation and of the availability of the procedure for resolving allegations of discrimination.

Corporate Affirmative Action Office at Central Office

The corporate affirmative action officer or designee is responsible for ensuring that each operating location is complying with the policy and requirements described in this procedure.
